Guidelines for Platform Usage

1. Introduction

This Acceptable Use Policy ("AUP") governs your use of the Avantwerk platform and all related services provided by Bennovate sp. z o.o. ("we", "us", or "Provider").

By accessing or using the Platform, you agree to comply with this AUP. This policy is incorporated into and forms part of our Terms of Service.

We reserve the right to modify this AUP at any time. Continued use of the Platform after changes constitutes acceptance of the revised policy.

2. General Conduct

You agree to use the Platform only for lawful purposes and in accordance with this AUP, our Terms of Service, and all applicable laws and regulations.

You are responsible for all activities conducted through your account, including actions taken by your employees, contractors, and any third parties to whom you grant access.

You must maintain accurate and up-to-date account information and promptly notify us of any unauthorised access or security breaches.

3. Prohibited Activities

3.1 Illegal Activities

You may not use the Platform to:

  • Violate any applicable local, national, or international law or regulation
  • Engage in money laundering, terrorist financing, or other financial crimes
  • Facilitate illegal gambling, drug trafficking, or human trafficking
  • Sell or distribute illegal products or services

3.2 Harmful Content

You may not use the Platform to create, store, transmit, or distribute:

  • Content that is defamatory, obscene, pornographic, or sexually explicit
  • Content depicting or promoting violence, self-harm, or abuse
  • Content that promotes hatred, discrimination, or harassment
  • Child sexual abuse material or content that exploits minors
  • Content that infringes intellectual property rights of third parties

3.3 Security Violations

You may not:

  • Attempt to gain unauthorised access to the Platform, other accounts, or networks
  • Probe, scan, or test the vulnerability of the Platform without authorisation
  • Interfere with or disrupt the Platform, servers, or networks
  • Deploy malware, viruses, Trojan horses, or other malicious code
  • Attempt to reverse engineer, decompile, or disassemble the Platform
  • Bypass or circumvent security measures or access controls

3.4 Spam and Abuse

You may not:

  • Send unsolicited bulk communications (spam) via email, SMS, or any other channel
  • Send messages to recipients who have not opted in or have opted out
  • Use deceptive subject lines, headers, or sender information
  • Harvest email addresses or other contact information without consent
  • Engage in phishing, spoofing, or social engineering attacks

3.5 Resource Abuse

You may not:

  • Use automated tools to access the Platform in a manner that exceeds reasonable use
  • Consume excessive bandwidth, storage, or computational resources
  • Use the Platform for cryptocurrency mining
  • Resell, sublicense, or redistribute Platform access without authorisation

4. Email and Communication Compliance

When using Platform communication features (email, SMS, chat), you must comply with:

CAN-SPAM Act (US) GDPR (EU/EEA) PECR (UK) CASL (Canada)

You must obtain proper consent before sending marketing communications and honour opt-out requests within the legally required timeframe.

You must include accurate sender information, a valid physical address, and a clear unsubscribe mechanism in all commercial communications.

5. Data Protection Responsibilities

Lawful Processing

You are responsible for ensuring that any personal data you process using the Platform complies with applicable data protection laws, including GDPR.

Privacy Notices

You must have a lawful basis for processing personal data and must provide appropriate privacy notices to data subjects.

Security Measures

Implement appropriate technical and organisational measures to protect personal data from unauthorised access, loss, or disclosure.

Sensitive Data

Do not process special category data unless you have explicit consent or another lawful basis with enhanced safeguards.

6. AI and Automation Features

When using AI-powered features (chatbots, content generation, automation), you must:

  • Disclosure: Clearly disclose to users when they are interacting with an AI system
  • Review: Review AI-generated content before publication to ensure accuracy and appropriateness
  • No Deception: Do not use AI features to generate misleading, deceptive, or harmful content
  • No Impersonation: Do not use AI features to impersonate real individuals without consent
  • Compliance: Comply with applicable AI regulations and guidelines

7. Reporting Violations

If you become aware of any violation of this AUP, please report it immediately to:

Reports should include as much detail as possible, including relevant URLs, screenshots, and a description of the violation. We will investigate all credible reports and take appropriate action.

8. Enforcement and Consequences

We reserve the right to investigate suspected violations of this AUP and take any action we deem appropriate, including:

Suspension
Termination
Legal Action

Important Notice

Serious violations may result in immediate termination without prior warning. No refunds will be provided for accounts terminated due to AUP violations. We may cooperate with law enforcement and regulatory authorities in investigating suspected criminal activity.

9. Indemnification

You agree to indemnify, defend, and hold harmless Bennovate sp. z o.o., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of this AUP or your use of the Platform.
